The following information is presented in connection with the application of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“GDPR”).

Therefore, we would like to inform you about the processing of data and the principles on which it will take place.

What is personal data?

Information that identifies you or allows you to be identified, e.g. name, surname, telephone number, or email address. PWEA collected and collects your data in connection with its statutory activities and marketing activities.

Data we process

We process the following data:

Who is responsible for the processing of personal data and who can be contacted?

The data administrator is the Polish Wind Energy Association, al. Wojska Polskiego 187/4-5, 71-325 Szczecin (hereinafter referred to as the “Administrator” or “PSEW”).

Why do we process your personal data and on what legal basis? What is the purpose of processing personal data?

Personal data processing takes place:

  • for the fulfillment of contractual obligations (Article 6(1)(b) of the GDPR)
  • for the fulfillment of legal obligations (Article 6(1)(c) of the GDPR) or the performance of tasks carried out in the public interest (Article 6(1)(e) of the GDPR)
  • for purposes arising from legitimate interests pursued by PWEA or a third party (Article 6(1)(f) of the GDPR)

If necessary, we process data to protect our own or third parties’ legitimate interests. Examples of such activities include: processing data of persons acting on behalf of clients, pursuing claims, and defending against claims.

Whom may we disclose personal data to?

Personal data may be disclosed to other recipients to fulfill contractual obligations, to perform a legal obligation incumbent on PSEW, based on your consent, or for purposes arising from the legitimate interests of PWEA or a third party.

Recipients may include, in particular: authorized PWEA employees and external companies providing internal services to PWEA (e.g., IT outsourcing).

In addition, data may be transferred to entities processing personal data on behalf of PSEW and their authorized employees, with such entities processing data based on an agreement with PSEW and solely in accordance with PSEW’s instructions and subject to confidentiality.

Will your personal data be transferred to a third country (outside the European Union)?

Personal data processed by PSEW is not transferred to recipients in countries outside the European Union (“third countries”). Transfer of personal data by PSEW to a third country is only possible if necessary to achieve the purposes arising from the legitimate interests pursued by PSEW. Any other transfer of data to a third country may occur after obtaining your consent.

You have the right, upon request to PSEW, to receive a copy of personal data transferred from a third country.

How long will PSEW process (store) your data?

Personal data will be processed for the period necessary to achieve the processing purposes, namely:

  • for the performance of a contract concluded with PSEW – until the completion of its performance, and thereafter for the period required by law or for the fulfillment of any claims;
  • for the fulfillment of legal obligations incumbent on PSEW, in connection with conducting business and fulfilling concluded agreements – until these obligations are fulfilled by PSEW;
  • for direct marketing carried out based on consent, until the withdrawal of consent for such processing;
  • until the fulfillment of the legitimate interests of PSEW, constituting the basis for this processing, or until you object to such processing, provided there are no legitimate grounds for further data processing.

What rights do you have regarding personal data?

You have the right to:

  • request access to your personal data and the right to rectify, limit the processing of personal data, or erase it;
  • where the processing of personal data is based on consent, you have the right to withdraw your consent at any time;
  • at any time, object to the processing of personal data:
    for reasons related to your particular situation, when PSEW processes data for purposes arising from legitimate interests (Art. 21(1) GDPR),
    for direct marketing purposes, including profiling for marketing purposes to the extent that the processing of your data is related to direct marketing (Art. 21(2) GDPR);
  • request the transfer of personal data processed in an automated manner for the purpose of concluding and performing a contract or based on consent. The transfer consists of receiving your personal data from PSEW in a structured, commonly used, machine-readable format and sending such data to another data controller;
  • submit a complaint to the supervisory authority, i.e., to the President of the Personal Data Protection Office, if you believe that the processing of your personal data violates GDPR regulations.

Where do we obtain your personal data from and what are their categories?

Primarily, personal data collected by PSEW comes directly from you (members, clients, employees, collaborators, individuals who left their contact information in email correspondence or by leaving a business card, visitors to the PSEW office, event participants). PSEW also processes certain categories of personal data that have not been obtained directly from you.
