The legislative process related to the amendment to the RES Act is prolonging. Unofficial information demonstrate that the draft will most likely not be submitted by the government to the Sejm until May.

The public consultations of the draft amendment to the RES Act have ended. PWEA actions during the consultations caused Ministry of Energy to abandon changes to the substitution fee calculation mechanism. Furthermore, a number of PWEA proposals was preliminarily accepted for further works on the draft at the governmental level.

Currently the draft is pending intergovernmental consultations. It is to be approved by particular committees of the Council of Ministers and subsequently the entire government.

Unofficial information demonstrate that the draft will most likely be submitted by the government to the Sejm in May. This is when the final wording of the document together with a statement of reasons will be published on the website of the Government Legislation Centre and the Sejm. In the Parliament the draft will most likely be submitted to the relevant committees, where MPs could submit further amendments to be voted by the Sejm and the Senate. The amendments could be both advantageous and disadvantageous for the industry. It is very likely that MPs will intend to submit the adopted Act to the President for signature before summer holiday, i.e. in June or July, to enable the ERO to hold auctions on the basis of provisions thereof already this year.
